Understanding the Article VII Permitting Process

Community Offshore Wind adheres to Article VII of the New York State Public Service Law, which regulates the siting of major utility transmission facilities. This law mandates a comprehensive review of the project’s necessity and the environmental impacts of its siting, design, construction, and operation. It also provides a platform for community members to engage with state and local agencies during the review process.

How does Article VII work

Application Submission

An application for a Certificate of Environmental Compatibility and Public Need (Certificate) is submitted to the Public Service Commission (PSC).

Review and Hearings

Once the application is deemed complete, Public Statement Hearings are scheduled to gather public feedback, and a Procedural Conference is held to determine the review process. The PSC accepts comments throughout the open docket period.

Certificate Issuance

The PSC issues a Certificate through an official order, detailing conditions for project construction and operation.

Environmental Plan Development

An Environmental Management and Construction Plan (EM&CP) is created, outlining the project’s construction approach. This plan is submitted to the PSC and made available for public comment.

Approval and Notification

After the PSC approves the EM&CP, public notifications are issued, and a Notice to Proceed must be obtained before construction can commence.

Construction and Monitoring

The project is monitored by regulatory authorities throughout construction, until the restoration of impacted areas is complete. Post-construction monitoring may also be required.

Throughout the permitting process, public meetings and hearings will be held by the Public Service Commission (PSC) to gather input and address any concerns. We encourage you to participate in these sessions to ensure your voice is heard.
